Dobrý večer,

hlavní dodavatel programového vybavení pro daňová přiznání použil jako
jednu z komponent systému knihovnu PJ, která je šířena za podmínek licence
GNU GPL (jak jsem později zjistil, je to uvedeno i na
http://adis.mfcr.cz/adis/jepo/info/licence.htm). Text této licence je
následující: http://www.gnu.org/licenses/gpl.txt

Všimněte si zejména posledního odstavce licence:

Tedy autoři programu zvolili právě licenci GNU GPL z toho důvodu, aby
nebylo možné jejich knihovnu začlenit do proprietárních programů.

V často kladených dotazech k licenci GNU GPL je uvedeno i následující:

Já jsem si z vašeho webu stáhl software epo.zip, jehož URL jsem zahlédl
v jedné z konferencí (URL zní přesně
http://adis.mfcr.cz/adis/jepo/offline/epo.zip) archív určený pro lokální
použití. V jednom z jeho souborů je i knihovna PJ uvolněná pod licencí GNU
GPL. Tímto bych chtěl vyjádřit své přání získat i zbytek aplikace pod
licencí GNU GPL, tedy včetně zdrojových textů. Toto přání je podloženo
bodem 2b licence GNU GPL:

Prosím, abyste mi sdělili, kde mohu zdrojové texty *celé* aplikace, která
je šířena pod licencí GNU GPL, stáhnout. Pokud celá aplikace není šířena
pod licencí GNU GPL, porušuje tím ministerstvo financí (které soubor
epo.zip distribuuje) licenci GNU GPL. Budu rád, když mi tuto informaci
potvrdíte.

Poté jsem se podíval i na samotné stránky aplikace, kde jsou dokonce i její
licenční podmínky. V těchto podmínkách přidáváte k celé aplikaci šířené pod
licencí GNU GPL (pokud tomu tak není, tak viz výše - porušujete licenci GNU
GPL) další dodatečné podmínky. Bohužel i tímto činem opět porušujete
podmínky licence GNU GPL, která v bodě 6 praví:

Přidáním dalších omezení (further restrictions) jste tedy opět porušili
licenční podmínky použitého softwaru!

Chtěl bych zde vyjádřit své vážné znepokojení nad touto situací a věřím, že
ministerstvo financí po konzultaci s ministerstvem informatiky a právníky
napraví vzniklou situaci a uvolní i zdrojové texty celé aplikace a tím
splní své povinnosti plynoucí z licence použitého software!
